Biography

Rajiv practices corporate and regulatory law with a focus on the healthcare sector. He has over 25+ years’ experience working for the Ontario government, a Bay Street national law firm and as Senior Corporate Counsel & Healthcare Compliance Officer and General Counsel for two global corporations. His former and current clients include a retired Prime Minister of Canada, governments, industry associations, regulated professionals and companies of all sizes and industries from small to medium sized businesses to multinational corporations.

His corporate/commercial practice involves buying and selling businesses, drafting and negotiating a broad range of commercial agreements including licensing, supply/distribution, manufacturing, outsourcing, transportation, marketing, joint ventures, consignment, warehousing, and services agreements.

His healthcare practice involves advising multinational companies, physicians and pharmacists on a broad range of matters including:

  • clinical trial agreements and commercial agreements with wholesalers, distributors, retail pharmacies;
  • submissions to Health Canada;
  • pre-Notice of Compliance materials for healthcare professionals, product launches, post-approval marketing materials (including detail aids, physician restricted websites, disease state material, and television/radio/ print advertising) and compliance with product labeling laws;
  • responses to buying group and hospital requests for proposals;
  • Patented Medicine Prices Review Board (PMPRB), formulary reimbursement and product listing agreements;
  • complaints relating to compliance with the Food & Drugs Act, Competition Act, Pharmaceutical Advertising Advisory Board Code of Advertising Acceptance, IMC Code of Ethical Practices and internal company codes of conduct;
  • product recalls for pharmaceuticals, medical devices, cosmetics and consumer products;
  • conducting internal healthcare and anti-corruption compliance investigations;
  • privacy and health information law and compliance;
  • federal and provincial access to information laws and government relations; and
  • training on all aspects of compliance including healthcare, anti-corruption/anti-bribery, competition law, marketing & advertising and contract risk management.

His regulatory law practice encompasses competition law (including marketing & advertising, promotional contests, merger clearance and general compliance), anti-corruption, healthcare and providing advice on federal and provincial laws related to pharmaceuticals, medical devices, cannabis, vaping, food, alcohol/spirits, cosmetics and natural health products. He also has experience in government procurement and international trade law including advising on the World Trade Organization (WTO) agreements, the North American Free Trade Agreement (NAFTA), bilateral investment treaties, anti-dumping & countervailing duty investigations, customs, export controls and economic sanctions.
